Right of Withdrawal
Pursuant to EU Consumer Rights Directive 2011/83/EU and FAGG (Austrian Distance Selling Act)
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the date of conclusion of the contract.
To exercise your right of withdrawal, you must inform us:
by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the model withdrawal form attached below, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and not later than fourteen days after the day on which we are informed about your decision to withdraw from this contract.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
Early Start of Service — Forfeiture of Withdrawal Right
Note for service contracts: If you have requested that performance of services begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.
The right of withdrawal also expires for a service contract if the trader has fully performed the service and performance of the service began only after the consumer gave their express prior consent and acknowledged that they will lose their right of withdrawal once the contract has been fully performed by the trader.

Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to the following contracts:
- Service contracts where the service has been fully performed and performance began with the consumer's express prior consent and acknowledgement that the right of withdrawal is lost once fully performed;
- Contracts for the supply of digital content not supplied on a tangible medium, where performance began with the consumer's express prior consent and acknowledgement that the right of withdrawal is thereby lost;
- Contracts between businesses (B2B) — the statutory right of withdrawal applies exclusively to consumers as defined in § 1 para. 1 no. 2 KSchG (Consumer Protection Act).
Note: BudiSync primarily serves commercial clients (fitness studios, practices, wellness businesses). The statutory right of withdrawal under FAGG applies only to consumers within the meaning of the Consumer Protection Act (KSchG). For B2B contracts, the termination provisions set out in the Terms and Conditions apply.
